Terms of service

OVERVIEW

Welcome to K&R London! The terms "we", "us" and "our" refer to K&R London. K&R London operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). K&R London is powered by Shopify, which enables us to provide the Services to you.

K&R London is the trading name of K&R Clothing Ltd, a company registered in England and Wales under company number 14725965 (VAT number 376275564), whose address is Unit 8, Cassia Building, 97 Hackney Road, London E2 8JE, United Kingdom. You can contact us at hello@kandrclothing.com.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.

These Terms apply to purchases from our online store. Purchases in our physical shop are covered by our in-store returns policy and your statutory rights. Wholesale and stockist accounts are covered by our separate trade terms.

Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability. If you live in the United States, Section 24 contains a binding arbitration agreement and class action waiver that affects how disputes are resolved. Please read it carefully.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. When you place an order, you will be asked to confirm that you accept these Terms. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

Consumers and business customers. Our products are sold for private, personal use. A "consumer" means an individual buying wholly or mainly for purposes outside their trade, business, craft or profession. Some sections apply only to consumers or only to business customers, and say so.

YOUR STATUTORY RIGHTS

Nothing in these Terms or our linked policies excludes or restricts your mandatory consumer rights, including rights relating to goods that are faulty, not as described or not fit for purpose, or applicable cancellation, delivery and refund rights.

Nothing excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be excluded or limited.

The qualifications concerning consumer rights in these Terms apply to every section, including the provisions concerning products, orders, delivery, warranties, liability and indemnification. If any other provision conflicts with these protections, these protections take precedence.

Your statutory rights depend on the country where you live. A summary for the UK, the European Union, Australia and the United States is in Section 22.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least 18 years old, or the age of majority where you live if that is higher. You may allow a minor in your care to use the Services under your supervision, and you are responsible for that use.

To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information.

You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

We may suspend or close an account, or decline future orders, where we reasonably believe the account is being used fraudulently, in breach of these Terms, or for abusive returns (see Section 3). This does not affect any order already accepted or any refund legally due to you.

SECTION 2 - OUR PRODUCTS

We have made every effort to provide an accurate representation of our products and services in our online stores. However, please note that colours or product appearance may differ from how they may appear on your screen due to the type of device you use to access the store and your device settings and configuration.

Product images are illustrative. Small differences between an image and the garment you receive, such as a shade shown differently on screen, do not on their own make a garment faulty or not as described.

All descriptions of products are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer to any person, geographic region or jurisdiction, on a case-by-case basis.

Fabric characteristics and variations

Many of our garments are made using deadstock fabrics. Minor variations in texture, colour and pattern placement may occur between garments. Any significant characteristics or variations will be explained in the relevant product description.

Deadstock and natural fabrics (including linen, wool and denim) naturally contain slubs, small irregularities, shade differences between batches and variation in pattern placement. These are characteristics of the fabric, not faults, and form part of the description of the goods you buy.

Product descriptions may be updated for future purchases. This does not change our obligation to supply goods that conform to the description and contractual information applicable when you placed your order.

Limited and one-off pieces

Many of our pieces are made in small runs and cannot be restocked. If an item becomes unavailable after you order it, we will tell you and refund you in full for that item. We cannot always offer a replacement.

Sizing and fit

Please refer to the relevant size guide and product-specific fit information before ordering. Where a size guide provides body measurements, these should not be treated as garment measurements. Fit may vary between styles, fabrics and designs. Nothing in this guidance limits your rights if an item is incorrectly described or supplied in the wrong size.

Garment care

Please follow the care instructions supplied with your garment and the guidance on our Fabric & Care page. Different fabrics and garment components may require different care methods. Inappropriate washing, drying or treatment may cause shrinkage, fading or damage.

We are not responsible for shrinkage, fading or damage caused by not following care instructions, normal wear and tear, accidental damage, or alterations made after delivery.

SECTION 3 - ORDERS, CANCELLATION AND RETURNS

How the contract is formed

When you place an order, you are making an offer to purchase. After you place an order, you will receive an email acknowledging that we have received it (an "Order Received" email). This email does not mean your order has been accepted. Our acceptance takes place, and a contract between you and us is formed, only when we email you to confirm that your order has been dispatched (a "Dispatch Confirmation"). If your order is sent in more than one parcel, the contract for each item is formed when that item is dispatched.

K&R London reserves the right to accept or decline your order for any reason at its discretion. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as K&R London may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e‑mail, billing address, and/or phone number provided at the time the order was made. Where we do not accept your order, we will refund any payment taken in full without undue delay.

Why we may decline or cancel an order

Without limiting the above, we may decline or cancel an order before dispatch where:

  • we suspect fraud or an unauthorised payment, or cannot verify your identity or payment details (we may ask you for verification before dispatch);

  • the order contains a pricing or description error (see Section 12);

  • an item is out of stock or unavailable;

  • we cannot deliver to the address given;

  • the order, or a series of orders, suggests buying for resale, or exceeds a quantity limit we have set;

  • a discount code or promotion has been used in breach of its terms; or

  • the customer's previous returns indicate abuse.

You represent and warrant that your purchases are for your own personal or household use and not for commercial resale. We may limit the quantity of any item per customer, order, household, address or payment method.

Cancellation rights

Our inability to stop or amend an order during processing does not remove any statutory right you have to cancel it.

For most online purchases governed by UK consumer cancellation law, you may notify us that you wish to cancel within 14 days after the day you, or a person you nominate, receives the goods. Where goods from a single order are delivered separately, the statutory cancellation period generally begins after the last item is received. You then have a further 14 days to send the goods back.

If you live in the European Union, you have an equivalent 14-day right of withdrawal under the law of your country, on the same basis.

Please use the returns process described in our Refund Policy wherever possible. You may also exercise a statutory cancellation right by emailing hello@kandrclothing.com with a clear statement that you wish to cancel and sufficient information to identify your order. Use of our returns portal is not a condition of exercising a statutory cancellation right.

Any applicable legal exceptions to cancellation rights will apply only where their requirements are met and will be explained before purchase where required. These exceptions may include items made to your specifications or clearly personalised, and swimwear, underwear or earrings where a hygiene seal has been removed after delivery.

In some countries, including Australia and the United States, there is no general legal right to cancel an online purchase because you have changed your mind. Customers in those countries may still return items for change of mind under our Refund Policy.

Returns and return condition

Returns and exchanges are administered in accordance with our Refund Policy, without limiting your statutory rights. Online orders cannot be returned in store, and items bought in store cannot be returned online. Items bought at an in-person sample sale are non-refundable unless faulty.

Please try garments on carefully and return them with their original tags and accessories wherever possible. Where permitted by law, we may reduce a refund to reflect a loss in value caused by handling beyond what is reasonably necessary to establish the garment's nature, characteristics and fit. We will explain any deduction. Removal of a tag does not, by itself, remove your statutory rights. Where you are not exercising a statutory cancellation right (for example, a change-of-mind return from outside the UK or EU), items not returned in the condition in which they were received may be rejected and returned to you.

For change-of-mind returns, you are responsible for the direct cost of returning the goods where this has been disclosed before purchase, unless we agree otherwise. For international orders, this includes return shipping and any duties, taxes or customs charges on the return journey. Where goods are faulty, incorrectly supplied or not as described, we will bear the reasonable return costs as required by applicable law. Please contact us so that we can arrange the appropriate return method.

Please package returns securely and retain proof of postage. Nothing in our returns process limits a right to reimbursement that arises when you provide legally sufficient evidence that goods have been sent back. Return items within 14 days of your return request. If you arrange your own return shipping, the parcel is your responsibility until it reaches us. We cannot refund returns that are refused, abandoned or returned to sender.

We may refuse a refund for, or send back to you at your cost, an item that is not the item we supplied. Where an item has been worn beyond trying on, washed, altered or damaged, the deduction rules above apply. We may decline future orders from customers whose returns show a pattern of abuse, such as repeated returns of worn items. This does not affect your statutory rights for faulty goods.

Exchanges

You can request an exchange for a different size or item through our returns portal, subject to availability. You are responsible for exchange postage costs. If the item you want is unavailable, we will refund you or give you store credit, as you choose.

Refund methods and timing

Refunds will be made to the original payment method unless you expressly agree otherwise. Store credit or an exchange will not replace a refund to which you are legally entitled unless you choose that option.

Where you exercise an applicable statutory right to cancel an entire online order, we will also refund the standard outbound delivery charge as required by law. Any additional amount paid for an upgraded delivery service need not be refunded where the law permits. If you cancel or return only part of an order, we do not refund the outbound delivery charge unless the law requires it. For orders delivered outside the UK and EU, the original delivery charge is non-refundable unless the item is faulty or not as described.

For UK statutory cancellations, we will issue the refund without undue delay and no later than 14 days after receiving the returned goods. Where there are no goods to return, or we have offered to collect them, the applicable statutory refund deadline will apply. Your payment provider may require additional time to display the refund. We process all other refunds within the same timeframe.

Refund amounts will reflect the price actually paid for the returned goods, including any applicable discount. We will not impose a refund processing fee where prohibited by law.

Faulty goods and sale items

Please contact hello@kandrclothing.com if you believe an item is faulty, damaged or not as described. We will assess the issue and provide the remedy required by applicable law. Sale items remain subject to the same statutory consumer rights as full-price items. The remedies available to you, and the time limits for claiming them, depend on the law of the country where you live (see Section 22).

Pre-orders

Where a product is offered on pre-order, this will be identified before purchase and an estimated dispatch date or timeframe will be provided. Any arrangements for shipping an order containing both pre-order and available items, including any additional split-shipping charges, will be disclosed before purchase or agreed with you separately.

We will notify you of material changes to an estimated dispatch timeframe. Pre-order status does not remove your statutory cancellation or delivery rights.

SECTION 4 - PRICES, PAYMENT, PROMOTIONS AND GIFT CARDS

Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your Order Received email. Delivery charges are shown at checkout before you pay.

Prices posted in our online stores may be different from prices offered in physical stores or in online or other stores operated by third parties. We may offer, from time to time, promotions on the Services that may affect pricing and that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.

You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our stores. You agree to promptly update your account and other information, including your email address, credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

You represent and warrant that (i) the credit card information you provide is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any.

Chargebacks

If you think you have been charged in error, please contact us first so that we can put it right. If a chargeback is raised for an order that was delivered as described, we may provide evidence of the order and delivery to your payment provider and may decline future orders.

Taxes, duties and international charges

For UK consumer purchases, displayed prices include VAT where applicable. For other destinations, the applicable product price, delivery charges and any taxes or import duties collected by us will be disclosed before you complete your purchase. Where taxes or duties are included in the displayed price, this will be stated.

United States: duties and taxes are collected at checkout. European Union and Monaco: duties and taxes are collected at checkout on orders over €150; for orders of €150 or less, VAT is collected at checkout under IOSS / is payable on delivery. Australia: GST is collected at checkout on orders of AUD 1,000 or less.

Where import duties, import taxes or clearance fees are payable directly to a customs authority or carrier, these charges are collected by that third party. We do not ordinarily refund charges paid directly to third parties; any available repayment may need to be requested from the relevant authority or carrier under its procedures. This does not exclude any liability or reimbursement obligation that we have under applicable law.

If you refuse to pay duties or taxes payable on delivery, or refuse delivery, and the order is returned to us, we will refund the price of the goods less the original delivery charge, the return shipping cost and any charges we incur, except where the law of your country requires us to refund more.

Any taxes or duties collected by us will be addressed in accordance with our Refund Policy and applicable law. Duties and taxes collected at checkout on orders to the United States, Australia and other destinations outside the UK and EU are non-refundable when you return items for change of mind; if an item is faulty or not as described, we will refund them. For orders to the EU and Monaco under €150, taxes collected at checkout on items you return are included in your refund. Nothing in these Terms permits us to withhold an amount that we are legally required to refund.

Foreign currency and payment-provider charges

Where a payment provider or bank converts a payment or refund into another currency, its exchange rate and any separate charges are determined by that provider. The converted amount of a refund may therefore differ from the converted amount originally paid. We will refund the amount due in the transaction currency, subject to applicable law.

Discount codes and promotions

Unless a promotion says otherwise:

  • only one discount code can be used per order, and codes cannot be combined with other offers;

  • codes have no cash value, cannot be exchanged or transferred, and cannot be applied after an order is placed or to past orders;

  • codes may exclude certain products, and expire on the date stated;

  • personal or single-use codes must not be shared or published, and we may cancel an order before dispatch that uses a code obtained or used in breach of its terms; and

  • if you return part of an order bought with a discount or threshold offer, your refund reflects the discount applied to the items you return.

Any "was" or reference price we show is a price at which the item was genuinely offered for sale. Countdown timers, offer end dates and low-stock messages reflect genuine offer periods and stock levels.

Gift cards and store credit

Gift cards and store credit do not expire. Gift cards are non-refundable, except where the law requires otherwise. Gift cards and store credit have no cash value and cannot be exchanged for cash, except where the law requires. They can be used only on our online store and in our shop. Please treat gift cards like cash: we cannot replace a lost or stolen gift card unless you can prove purchase and it has not been used.

SECTION 5 - SHIPPING AND DELIVERY

Delivery times

Delivery times shown at checkout are estimates. We aim to dispatch orders within 2 working days. Where we have agreed a delivery date or period with you, we will meet it. Where none has been agreed, we will deliver without undue delay and within 30 days of the contract being made, unless the law of your country sets a different period.

Risk and ownership

If you are a consumer, the goods are our responsibility until they are delivered to you, to a person you nominate, or to a safe place you have chosen. A statutory exception may apply where you independently commission a carrier that we have not offered. Ownership of the goods passes to you once we have received payment in full and the goods are delivered. If you are a business customer, risk passes to you when we hand the goods to the carrier.

Estimated delivery times do not remove our obligation to meet an agreed delivery deadline or your statutory rights concerning delayed delivery.

Delivery information and problems

Please ensure that your delivery address and contact details are accurate when placing an order. If you notice an error, contact us promptly. We will try to accommodate corrections, but changes may not be possible once processing or dispatch has begun. Any agreed additional delivery charges will be explained before being charged.

If an order is returned to us because the address you gave was incorrect or incomplete, or because it was not collected from the carrier, we will contact you. We may charge you the cost of re-sending it, or if you cancel, refund you less the delivery costs we have incurred, except where the law requires otherwise.

If an order arrives damaged or appears to be missing, please contact us at hello@kandrclothing.com so that we can investigate and arrange the appropriate remedy. A carrier's delivery scan does not, by itself, remove your statutory rights if you have not received the goods. Please tell us about a missing parcel within 30 days of dispatch, and about visible damage within 14 days of delivery, so that we can claim from the carrier in time. Telling us later does not remove your statutory rights, but may make an investigation harder.

International orders may be delayed by customs. Delays caused by customs or carriers outside our control are dealt with under Section 15.

Nothing in this section limits your statutory rights concerning delivery, refunds or other remedies.

SECTION 6 - INTELLECTUAL PROPERTY

Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by K&R London, its affiliates or licensors and are protected by copyright, design right, trade mark and other intellectual property laws in the United Kingdom and other countries. Our garment designs, prints and photography are original works, and you must not copy or reproduce them.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent. Except as expressly provided herein, nothing in these Terms grants or shall be construed as granting a license or other rights to you under any patent, trademark, copyright, or other intellectual property of K&R London, Shopify or any third party. Unauthorized use of the Services may infringe intellectual property laws. All rights not expressly granted herein are reserved by K&R London.

K&R London's names, logos, product and service names, designs, and slogans are trademarks of K&R London or its affiliates or licensors. You must not use such trademarks without the prior written permission of K&R London. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

SECTION 7 - OPTIONAL TOOLS

You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control nor input.

You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

We may also, in the future, offer new features through the Services (including the release of new tools and resources). Such new features shall also be deemed part of the Services and are subject to these Terms of Service.

SECTION 8 - THIRD-PARTY LINKS

The Services may contain materials and hyperlinks to websites provided or operated by third parties (including any embedded third party functionality). We are not responsible for examining or evaluating the content or accuracy of any third-party materials or websites you choose to access. If you decide to leave the Services to access these materials, you do so at your own risk.

We are not liable for any harm or damages related to your access of any third-party websites, or your purchase or use of any products, services, resources, or content on any third-party websites. Please review carefully the third-party's policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products and services should be directed to the third-party.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

K&R London is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with K&R London. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and K&R London, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with K&R London.

SECTION 10 - PRIVACY POLICY

All personal information we collect through the Services is subject to our Privacy Policy, which can be viewed here, and certain personal information may be subject to Shopify's Privacy Policy, which can be viewed here. By using the Services, you acknowledge that you have read these privacy policies.

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve the Services for you. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in other countries than where you reside, in order to provide services to you. Review our privacy policy here for more details on how we, Shopify, and our partners use your personal information.

SECTION 11 - FEEDBACK AND REVIEWS

If you submit, upload, post, email, or otherwise transmit any ideas, suggestions, feedback, reviews, proposals, plans, or other content (collectively, "Feedback"), you grant us a perpetual, worldwide, sublicensable, royalty-free license to use, reproduce, modify, publish, distribute and display such Feedback in any medium for any purpose, including for commercial use. We may, for example, use our rights under this license to operate, provide, evaluate, enhance, improve and promote the Services and to perform our obligations and exercise our rights under the Terms of Service.

You also represent and warrant that: (i) you own or have all necessary rights to all Feedback; (ii) you have disclosed any compensation or incentives received in connection with your submission of Feedback; and (iii) your Feedback will comply with these Terms. We are and shall be under no obligation (1) to maintain your Feedback in confidence; (2) to pay compensation for your Feedback; or (3) to respond to your Feedback.

We may, but have no obligation to, monitor, edit or remove Feedback that we determine in our sole discretion to be unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party's intellectual property or these Terms of Service.

You agree that your Feedback will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your Feedback will not contain libelous or otherwise unlawful, abusive or obscene Feedback, or contain any computer virus or other malware that could in any way affect the operation of the Services or any related website. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any Feedback. You are solely responsible for any Feedback you make and its accuracy. We take no responsibility and assume no liability for any Feedback posted by you or any third-party.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS

Occasionally there may be information on or in the Services that contain typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).

Pricing errors. If we find an error in the price or description of an item you have ordered before we dispatch it, we will contact you, and you may either confirm the order at the correct price or cancel it for a full refund. If the error is obvious and could reasonably have been recognised by you as a mistake, we do not have to supply the item at the incorrect price, even after dispatch, where the law allows.

Where we decline or cancel an order, we will refund any payment due back to you without undue delay. Our rights under this section are subject to applicable law and do not permit us to disregard a binding contract or your statutory rights.

SECTION 13 - PROHIBITED USES

You may access and use the Services for lawful purposes only. You may not access or use the Services, directly or indirectly: (a) for any unlawful or malicious purpose; (b) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (c) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (d) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or harm any of our employees or any other person; (e) to transmit false or misleading information; (f) to send, knowingly receive, upload, download, use, or re-use any material that does not comply with the these Terms; (g) to transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation; (h) to impersonate or attempt to impersonate any other person or entity; or (i) to engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm K&R London, Shopify or users of the Services, or expose them to liability.

In addition, you agree not to: (a) upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Services; (b) reproduce, duplicate, copy, extract, sell, resell or exploit any portion of the Services; (c) collect or track the personal information of others; (d) spam, phish, pharm, or pretext the services; (e) use any robot, spider, scraping, data gathering and extraction tools, automatic devices or processes, or AI tools (such as agentic AI), to access the Services, except as permitted by Section 14; (f) use bots or automated means to buy products, or buy in a way intended to get around quantity limits; or (g) interfere with, bypass, or circumvent the security or authorization features, robot exclusion headers, or other measures we employ to restrict access to the Services. We reserve the right to suspend, disable, or terminate your account at any time, without notice, if we determine that you have violated any part of these Terms.

SECTION 14 - AGENTS

14.1 This section ("Agent Terms") applies if you use, allow, enable, or cause the deployment of an Agent to access, use, or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity and that can be executed on behalf of or using persons device, without direct supervision.

14.2 No Agent may access, use, or interact with Services unless, at all times, it identifies itself and operates in strict accordance with the requirements in section 14.4 below. In addition, no Agent may access, use, or interact with Services if we have requested that the Agent refrain from accessing, using, or interacting with any service.

14.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, and interacts with Services.

14.4 Agents must: (i) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the name of the Agent by including the following in the request's user agent string: "Agent/[agent name]"; (ii) not conceal or obfuscate that any access, use, or interactions are from an Agent, such as by (a) mimicking human behavior and interaction patterns, or (b) completing or circumventing CAPTCHAs or measures intended to distinguish computer use from humans, (iii) respond truthfully to any question or prompt seeking to determine if interactions are coming from a human or a computer, (iv) not circumvent or otherwise avoid any measure intended to block, limit, modify, or control whether and how Agents access, use, or interact with the Services.

14.5 You are responsible for any order placed by an Agent acting for you, as if you had placed it yourself.

SECTION 15 - EVENTS OUTSIDE OUR CONTROL

We are not responsible for delay or failure to perform caused by events outside our reasonable control. These include carrier or postal disruption, strikes, customs delays, extreme weather, fire, flood, epidemic, war, cyber-attack, power or internet failure, and failure of a supplier. If such an event happens, we will tell you as soon as possible, take reasonable steps to minimise its effect, and our time to perform will be extended for as long as the event lasts. If the delay is substantial, you may cancel and we will refund you for any goods you have not received. This section does not affect your statutory rights.

SECTION 16 - TERMINATION

We may terminate this agreement or your access to the Services (or any part thereof) in our sole discretion at any time without notice, and you will remain liable for all amounts due up to and including the date of termination.

The following sections continue to apply after termination: Intellectual Property, Feedback and Reviews, Termination, Our Responsibility for Loss or Damage, Indemnification, Severability, Waiver and Entire Agreement, Assignment, Governing Law, Dispute Resolution for US Customers, Privacy Policy, and any other provisions that by their nature should survive termination.

Termination of access to the Services does not remove your statutory rights or our obligations concerning purchases already made, including any refund or remedy legally due to you.

SECTION 17 - OUR RESPONSIBILITY FOR LOSS OR DAMAGE

17.1 Consumers. We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or our failing to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen, or if both you and we knew it might happen when the contract was made. We are not responsible for loss or damage that is not foreseeable.

17.2 What we do not limit. We do not exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your statutory rights in relation to the goods (including that they are as described, of satisfactory quality and fit for purpose), and for defective products under product liability law.

17.3 Private use only. We supply products for private use only. If you use them for any commercial, business or resale purpose, we have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.

17.4 Things we are not responsible for. We are not responsible for loss or damage caused by not following care instructions, normal wear and tear, alterations, events outside our control (Section 15), or your use of the Services in breach of these Terms.

17.5 Business customers. If you are not a consumer, then to the fullest extent permitted by law: all warranties, conditions and other terms implied by statute or common law are excluded; we are not liable for any indirect or consequential loss, or for any loss of profit, revenue, business, goodwill or data; and our total liability in connection with any order is limited to the price paid for that order.

17.6 Information on the Services. Information on the Services, other than product descriptions and the terms of your order, is provided for general information only. We do not warrant the accuracy, completeness, or usefulness of this information. To the extent permitted by law, we do not guarantee that the Services will be uninterrupted, timely, secure or error-free.

17.7 Additional terms for customers in the United States. If you live in the United States, the following applies to the fullest extent permitted by applicable law, subject to Section 22:

EXCEPT AS EXPRESSLY STATED BY K&R London, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT.

IN NO CASE SHALL K&R London, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT(S) GIVING RISE TO THE CLAIM. SOME JURISDICTIONS LIMIT OR DO NOT ALLOW THE DISCLAIMER OF IMPLIED OR OTHER WARRANTIES OR THE LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.

SECTION 18 - INDEMNIFICATION

If you are a business customer, or to the extent permitted by applicable law if you are a consumer, you agree to indemnify, defend and hold harmless K&R London, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, payable to any third party due to or arising out of (1) your breach of these Terms of Service or the documents they incorporate by reference, (2) your violation of any law or the rights of a third party, or (3) your access to and use of the Services.

We will notify you of any indemnifiable claim, provided that a failure to promptly notify will not relieve you of your obligations unless you are materially prejudiced. We may control the defense and settlement of such claim at your expense, including choice of counsel, but will not settle any claim requiring non-monetary obligations from you without your consent (not to be unreasonably withheld). You will cooperate in the defense of indemnified claims, including by providing relevant documents.

For consumers, this section applies only to the extent permitted by applicable law. It does not require you to compensate us or any other party merely for making lawful use of the Services, exercising your statutory rights, or for losses caused by that party's own breach of contract, negligence or unlawful conduct.

SECTION 19 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

SECTION 20 - WAIVER; ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.

These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and governs your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).

For consumer contracts, nothing in this section excludes information, statements or representations that form part of the contract under applicable law. Where the law requires an ambiguous consumer term to be interpreted in the consumer's favour, that requirement takes precedence.

SECTION 21 - ASSIGNMENT

You may not delegate, transfer or assign this Agreement or any of your rights or obligations under these Terms without our prior written consent, and any such attempt will be null and void. We may transfer, assign, or delegate these Terms and our rights and obligations without consent or notice to you.

Any transfer by us will not reduce your statutory protections or materially disadvantage you in relation to an existing consumer contract. We will provide notice where required by law.

SECTION 22 - YOUR RIGHTS BY COUNTRY

This section summarises key consumer rights. It is not a complete statement of the law, and it does not reduce any right you have.

United Kingdom

Under the Consumer Rights Act 2015, goods must be as described, of satisfactory quality and fit for purpose. If they are not, you can reject them for a full refund within 30 days of delivery. After that, you can ask for a repair or replacement, and if that fails, a price reduction or a refund. You have up to six years to bring a claim (five years in Scotland). For more information, contact Citizens Advice.

European Union

If you live in the EU, you have a legal guarantee of conformity for at least two years from delivery under the law of your Member State, and a 14-day right of withdrawal for online purchases. For more information, contact your national consumer authority or the European Consumer Centres Network.

Australia

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law.

United States

You may have rights under the consumer protection laws of your state that cannot be waived, and nothing in these Terms limits them. Some states do not allow the exclusion of implied warranties or the limitation of incidental or consequential damages, so parts of Section 17.7 may not apply to you. California residents: under California Civil Code Section 1789.3, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

Other countries

If you live elsewhere, you keep any rights that the law of your country gives you and that cannot be excluded by contract.

SECTION 23 - GOVERNING LAW AND WHERE TO BRING A CLAIM

These Terms, and any dispute or claim arising out of or in connection with them or your purchases (including non-contractual disputes or claims), are governed by the laws of England and Wales.

If you are a consumer, this choice of law does not deprive you of mandatory protections that apply under the law of your country of habitual residence. Nothing in these Terms prevents you from bringing proceedings in any court where you have a right to do so under applicable law. If you live in Scotland or Northern Ireland, you may bring proceedings in the courts there.

If you are a business customer, the courts of England and Wales have exclusive jurisdiction.

If you live in the United States, Section 24 applies to disputes between you and us.

Before bringing any claim, please contact us at hello@kandrclothing.com so that we can try to resolve the matter. We do not currently use an alternative dispute resolution provider, but we may agree to do so for a particular dispute.

SECTION 24 - DISPUTE RESOLUTION FOR CUSTOMERS IN THE UNITED STATES

PLEASE READ THIS SECTION CAREFULLY. IF YOU LIVE IN THE UNITED STATES, IT REQUIRES YOU TO RESOLVE DISPUTES WITH US THROUGH INDIVIDUAL BINDING ARBITRATION AND LIMITS THE WAYS YOU CAN SEEK RELIEF, INCLUDING BY WAIVING CLASS ACTIONS AND JURY TRIALS.

24.1 Informal resolution first. If you have a dispute with us, you must first send a written notice describing it and the relief you want to hello@kandrclothing.com. We will try to resolve it informally. If it is not resolved within 60 days of your notice, either of us may start arbitration.

24.2 Binding arbitration. Any dispute, claim or controversy arising out of or relating to these Terms, the Services or any product purchased from us will be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect. The Federal Arbitration Act governs the interpretation and enforcement of this Section 24. The arbitration may be conducted by video, by telephone or on written submissions, and any in-person hearing will take place in the county where you live. Payment of fees will be governed by the AAA Consumer Arbitration Rules.

24.3 Exceptions. Either of us may bring an individual claim in small claims court if it qualifies, and either of us may seek injunctive relief in court to protect intellectual property rights.

24.4 Class action and jury trial waiver. YOU AND WE EACH AGREE THAT CLAIMS MAY BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. YOU AND WE EACH WAIVE THE RIGHT TO A TRIAL BY JURY.

24.5 Opting out. You may opt out of this Section 24 by emailing hello@kandrclothing.com with the subject line "Arbitration Opt-Out", your name and your order number, within 30 days of first accepting these Terms. Opting out does not affect any other part of these Terms.

24.6 If any part fails. If the class action waiver in Section 24.4 is found to be unenforceable for any claim, that claim must be decided in court and not in arbitration. If any other part of this Section 24 is found to be unenforceable, the rest of it continues to apply.

SECTION 25 - HEADINGS

The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

SECTION 26 - CHANGES TO TERMS OF SERVICE

You can review the most current version of the Terms of Service at any time on this page.

We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes. We will notify you of any material changes to these Terms in accordance with applicable law, and such changes will be effective on the date specified in the notice. Your continued use of or access to the Services following the posting of any changes to these Terms of Service constitutes acceptance of those changes.

Changes to these Terms will not retrospectively alter the terms of purchases already made, except where required by law or expressly agreed with you. The Terms that apply to an order are those in force when you placed it.

SECTION 27 - CONTACT INFORMATION AND COMPLAINTS

Questions about the Terms of Service should be sent to us at hello@kandrclothing.com. If you have a complaint, please email us with your order number. We aim to respond within 5 working days.
